FAQ’s

In Queensland, you are required to engage a solicitor to attend to the conveyancing. At GM Law, all of your conveyancing is handled by qualified solicitors admitted to the Supreme Court of Queensland, so you get full legal advice and protection – not just paperwork processing.

The contract itself sets the timeframes. Typically, settlement occurs 30 days after the contract date for established properties. Off-the-plan purchases can take considerably longer. We will keep you across all key dates from the moment you engage us.
Technically yes, but it is not advisable. Queensland property law is complex, deadlines are strict, and the financial stakes are high. A missed search or an incorrectly executed transfer document can cost you far more than any professional fee. We are happy to discuss the risks with you before you decide.
Delays can happen for a number of reasons .If your settlement is delayed, we will advise you immediately on your rights under the contract and work to resolve the issue as quickly as possible.
Rarely. Most of our clients deal with us entirely by phone, email, or post. However, if you are based near our Brisbane or Cleveland office and prefer to meet in person, we are always happy to arrange that.

Standard searches include a title search, rates search, water and sewerage search, and land tax clearance. Depending on the property, we may recommend additional searches such as a drainage search, contaminated land search, or environmental management register search. We will advise you on what is appropriate for your specific property.

Search fees are charges levied by local councils, the Titles Registry, and government bodies – they are passed on to you at cost. They are not a profit margin for us.

Transfer duty is a Queensland government tax payable by the buyer based on the purchase price. The amount varies depending on the price and whether you qualify for any concessions (e.g. first home buyer). We are self-assessors for transfer duty and will calculate and lodge your duty assessment as part of the conveyancing process. A title search confirms who legally owns the property, reveals any mortgages or encumbrances registered against it, and identifies any easements, caveats, or covenants that affect the land. We conduct this search at the outset and again just before settlement.

An easement is a legal right for someone else to use part of your land for a specific purpose – for example, a utility company running pipes or cables underneath. Easements are registered on the title and transfer with the property, so it is important you understand them before you buy. We will explain any easements disclosed in your contract or revealed by our searches. A caveat is a formal notice lodged on a property’s title by a person claiming an interest in it. It prevents the property from being sold or transferred until the caveat is resolved. We check for caveats as part of our standard title searches.
For residential property contracts in Queensland, buyers generally have a 5-business-day cooling-off period after signing. If you terminate during this period, a penalty of 0.25% of the purchase price applies. Contracts entered into at auction do not have a cooling-off period. We will advise you on your specific rights when you engage us.
Settlement is the moment ownership legally transfers. The buyer’s solicitor and seller’s solicitor (along with their respective financiers, if applicable) exchange documents and funds. In Queensland, most settlements now occur electronically through PEXA. We attend or manage settlement on your behalf and notify you and the agent once it is complete.
PEXA (Property Exchange Australia) is the electronic settlement platform used for most Queensland property transactions. It allows solicitors and financiers to exchange documents and transfer funds digitally, making settlement faster and more secure. We are experienced PEXA users and manage this on your behalf.

Our conveyancing fees for buyers range from $1,230 plus GST and outlays (for residential properties under $1M – Gold package), and for sellers from $895 plus GST and outlays. Use our instant quote tool for a precise figure based on your property details.

Outlays are third-party costs – primarily property search fees payable to councils, the Titles Registry, and government bodies. These are charged at cost with no mark-up. We include an estimate of outlays in your quote.

Yes. Our quoted professional fee is fixed. We will be transparent about any additional charges before they are incurred – for example, if your matter requires additional work due to an extension, a dispute, or a complex title issue.

Buyers require a more extensive scope of work. We conduct comprehensive property searches, manage your finance and building and pest conditions, prepare the transfer documents, and coordinate with your financier for settlement. Sellers have fewer searches and conditions to manage.
We charge a small administrative fee to cover file-opening, contract review, and initial correspondence. Our full professional fee only applies on settlement.
